Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and JLab AI LLC, a Florida limited liability company doing business as Goodnightly ("Goodnightly," "we," "us," or "our"). They govern your use of the Goodnightly website and subscription service (the "Service").

By subscribing to or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

Goodnightly is a subscription service that generates a personalized, AI-written bedtime story for your child and delivers it to your email each evening. Some plans also include a printable coloring page based on that night's story. Stories are personalized using information you provide, such as your child's first name, age range, and interests.

2. Eligibility

You must be at least 18 years old and the parent or legal guardian of any child whose information you provide. By using the Service, you represent that you meet these requirements and that you have the authority to provide the information you submit.

3. Your account and information

The Service currently does not require a password-based login. You are responsible for the accuracy of the information you provide and for keeping your email account secure, since stories and account communications are delivered there. You agree to provide accurate information and to update it as needed.

4. Subscriptions, billing, and cancellation

Billing. Paid plans are billed in advance on a recurring basis (monthly or annual, depending on the plan you choose) through our payment processor, Stripe. Prices are shown at the time of subscription.

Automatic renewal. Your subscription automatically renews at the end of each billing period at the then-current price, until you cancel. By subscribing, you authorize us to charge your payment method on a recurring basis.

Cancellation. You may cancel at any time. When you cancel, your subscription remains active until the end of the current billing period, and you will not be charged again after that. To cancel, contact us at the email below (or use any self-service cancellation option we provide).

Refunds. Except where required by law, payments are non-refundable, including for partial billing periods. We may, at our discretion, offer a refund or credit in individual cases.

Price changes. We may change our prices. If we do, we will give you advance notice, and the new price will apply to your next billing period after the notice.

5. AI-generated content and parental discretion

Stories and coloring pages are generated by artificial intelligence based on the information you provide. We apply automated safety checks designed to keep stories age-appropriate, gentle, and free of frightening or unsafe content. No automated system is perfect, however. Stories are works of fiction for entertainment, and you are responsible for reviewing content you share with your child. If you ever receive a story you feel is inappropriate, please let us know so we can improve.

6. Acceptable use

You agree not to:

• Use the Service for anything other than personal, non-commercial enjoyment by your family
• Resell, redistribute, or publicly share generated stories or images for commercial purposes
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service
• Provide information about a child for whom you are not the parent or guardian
• Use the Service in violation of any applicable law

7. Intellectual property and your license

The Goodnightly name, website, and software are owned by us. The personalized stories and coloring pages we deliver to you are provided for your personal, non-commercial use, and you may read, print, and enjoy them with your family. You may not sell them or use them commercially.

8. Third-party services

The Service relies on third-party providers (including Stripe, Resend, Airtable, Anthropic, Cloudflare, and FAL.ai). Your use of the Service is also subject to those providers' terms where applicable. We are not responsible for the acts or omissions of third-party providers.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that every story will meet your expectations.

10. Limitation of liability

To the fullest extent permitted by law, JLab AI LLC and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold harmless JLab AI LLC and its owners from any claims, damages, or expenses arising out of your use of the Service or your violation of these Terms.

12. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you by email. Your continued use of the Service after changes take effect means you accept the updated Terms.
